The Harness Horse Association of Central New York will hold its annual membership meeting on Sunday, October 23, 2011.  The meeting will be held at 1:00 p.m.  The new pension plan will be discussed.

 

A prime rib and chicken dinner will follow the meeting.  This event will be held at the Nothin’ Fancy Country Addition from 1:30 p.m. to 5:00 p.m.  The dinner is free.

 

The menu includes prime rib, marinated chicken, mashed potatoes, salad, vegetable, greens and more.  Coffee, soda, and beer are included.

 

Please contact this office by October 17, 2011 if you plan to attend.

HHA of CNY (Vernon Downs) Directors Elected

The Certified Public Accounting firm of Catherine Benson has reported the results of the election for Board of Directors of the Harness Horse Association of Central New York in a report to the election committee. The election conducted results were made known on September the 20th and announced by the President Rick Papa as follows:

Lon Rosenfeld was unopposed in the trainer/driver category and will commence a full 3-year term.

Incumbents Vladimir Melnichenko and George Shaheen were re-elected to 3-year terms defeating Jaclyn Bailey and Salvatore Vullo in the owner category.

Rick Papa wishes to thank everyone who showed enough interest in the affairs of the Horsemen’s Association to run and take part in the process and added “that he expects those incumbent directors who were reelected to continue their fine work on behalf of the organization”. “This included the implementation of a very fine scholarship program and more recently a pension plan for those horsemen who have supported racing at Vernon for all these many years and continue to do so today”.

The Board of Directors of the HHA of CNY is pleased to announce a new benefit never before available at Vernon Downs, a pension plan for qualified individuals. 

 

We are in the final stages of instituting a pension plan to help meet the needs of our most loyal participating horsemen supporting racing at Vernon Downs over these many years. Trainers and drivers who meet established criteria will be eligible and will receive benefits to be made retroactive to 2010. This is the first time a pension plan for trainers and drivers has ever been offered at Vernon Downs and it is being offered because the Board of Directors of your Association has chosen to warehouse monies it has negotiated for your benefit. As we promised years ago, we needed time to amass enough finances to subsidize the initial phases of a plan that will provide you with benefits because of your labors on behalf of racing here at Vernon Downs.

 

Often we have been criticized for our focus on what benefits you, but we remain committed to one goal - what is in the interests of our membership. The Board of Directors of the HHA of CNY has stood firm in its efforts to provide benefits to our membership and we will continue to do so.

 

Our scholarship benefit for the horsemen and their families is one of the best in our industry. These things happen because of an unselfish interest by your Board of Directors in what provides a benefit to you. We expect that all of the particulars of this plan will be made available in the fall.  The current Board of Directors has worked hard reviewing the pension plans at other tracks from Western NY to the downstate tracks and believe we are on the right track to providing our members with what will be a very meaningful benefit over the years, certainly a first step in the right direction.  We will keep you updated as the specific details of this new plan become available.

Supreme Court Strikes Down N.Y. Out of Competition Testing Rules

            After an over three-year battle led by The SOA of NY and joined by the Empire State Harness Horsemen's Alliance (comprised of the representative horsemen's associations at Yonkers, Monticello, Buffalo, Batavia, Vernon and Saratoga) to achieve proper, fair and enforceable out of competition testing rules, a state judge has struck down the ill-advised rules that were promulgated over the horsemen's numerous and valid objections.

 

            By a decision filed on August 15, Acting New York State Supreme Court Justice Mark L. Powers ruled in Ford et al. v. The New York State Racing and Wagering Board that the Racing Board's Out of Competition Testing Rules enacted on December 15 2009 were, also lacking in reason as to require nullification in their entirety.

 

            The Court began its analysis by recognizing that all parties, including the states horsemen, concur that drug testing is essential to the harness horse racing industry, the betting publics confidence and the health of racehorses. The court then went on to fully agree with the horsemen that the Racing Boards unilaterally adopted Out of Competition testing regulations were illegal, conceived in excess of the Boards jurisdiction, arbitrary, capricious, overbroad, unconstitutionally vague and overly intrusive.

 

            The decision of the Court recognized that in July of 2008 the SOA of New York conveyed to the Racing Board, in writing, various criticisms of the proposed regulations. The Court further found that not only did the Board fail to address or even reply to the horsemen's concerns, but that the next thing the horsemen heard from the Racing Board was the pronouncement that the troubling, and now found to be illegal, Out of Competition testing scheme had been adopted by the Board. The Court then noted that the voiced concerns from the SOA of NY from three years ago all had merit.

 

            Among the specific reasons the Court voided the testing scheme were the fact that the portion of the rule that allowed for testing of horses 180 days before they competed was arbitrary, overly broad, vague and, most importantly, devoid of any scientific basis. Further, the Court determined that the Boards admissions that it did not intend to utilize sophisticated testing techniques that would have sufficiently allowed for a proper scientific testing protocol due to cost, offer little solace to those affected by the Boards reliance on antiquated testing protocols. In sum, the court ruled that the Boards failure to employ less restrictive alternatives, notwithstanding associated costs, was irresponsible.

 

            The court further determined that requiring horses to be tested if found within 100 miles of a racetrack was arbitrary, capricious and without justification. The Court adopted the horsemen's argument that the rule lack proper enforcement efficacy, as ethical horsemen would be subjected to intrusive testing while unscrupulous horsemen could simply set up shop 101 miles from the racetrack. The irony of this was not lost on the Court: It is illogical that in an effort to catch the cheaters, the Board itself creates a situation so easily subject to exploitation.

 

            Additionally, Judge Powers determined that the Racing Boards attempt at self-imposed authority to enter onto private property is overbroad and contrary to fundamental rights.

 

            In addition to the purely constitutional and legal defects of the testing scheme, the Court also addressed the rules internal inconsistencies with regard to medication administration. Here, the court agreed with the submitted affidavits of a variety of veterinary experts that the face of the out of competition testing rules would prohibit, not to mention subject violators to penalties which shocks the conscience, administration of substances that are otherwise permissible therapeutics pursuant to other long standing Racing Board rules. As the Court aptly stated, The difficulty of prohibited substances being both prohibited and permissible, depending upon the surrounding circumstances and purpose for administration, is that the Board could choose to invoke its severe penalties in situations when the particular substance was used properly for its recognized therapeutic value.      

 

            Going even further, the Court surveyed the rules in other states and concluded that no other jurisdiction categorically bans all protein and peptide-based substances without regard to their therapeutic value. The Court was equally concerned with the Racing Boards most grave of departures via its complete omission of a split sampling procedure necessary to safeguard against false positive results.

 

            Speaking for Petitioner Standardbred Owners Association of New York, its President, Joseph Faraldo, stated: "We could not agree more with Justice Powers conclusion that there is an, ‘inherent unfairness to adopting rules that sweep across an entire Industry, looking for one bad apple and subject to all kinds of abuses in implementation and enforcement without any built-in protections for those affected and with disregard for their legitimate concerns. Rather than adopting a testing scheme that doesn't snag the cheaters, we implored the Racing Board three years ago to amend their proposed rules so as to adopt a protocol that would efficaciously catch  cheaters and punish them severely, while providing legitimate safeguards. That plea by way of industry input that was very detailed and practical fell on deaf ears, and Judge Powers decision is thus a surprise to no one.  The horsemen's suggestions that were based on years of in-the-trenches experience were ignored and the result is that there is no meaningful reform.

 

            In addition to the Standardbred Owners Association of New York, the petitioners were U.S.T.A. director Mark Ford, SOA director and USTA district chairman John Brennan, veteran horseman Richard Banca, Sr and SOA executive director George Casale.

 

            The Petitioners were successfully represented by Andrew J. Turro, Esq. of the law firm Meyer, Suozzi, English & Klien, P.C..

 










HHA OF CNY Scholarship Committee Chairman Dr. Joseph Camerino and 2011 First Place scholarship winner Howard Bantle of Vernon, NY.

The Harness Horse Association of Central New York is proud to announce the 2011 scholarship winners.

First place winner of $5,000 is Howard Bantle of Vernon, NY.  Howard, an honors student with a 97.1 cumulative average is a 2011 graduate of Vernon-Verona-Sherrill Central School and will be attending Niagara University.  He is majoring in Psychology and hopes to help soldiers with Post Traumatic Stress Syndrome.  Howard is the son of trainers Terry Bantle and Eric Felter.  Dr. Joseph Camerino, scholarship committee chairman presented Howard with the check.

Based on the point system used to award the scholarships, the committee could not break the tie for the remaining two scholarships.  The second and third place monies were combined and split evenly between Ashley Eldred of Burlington Flats, NY and Ryan Mogensen of Westernville, NY.  Each will receive $ 2,000.

Ashley is the daughter of trainer Ann Yurenka and is a 2011 graduate of Edmeston Central School.  She will be attending SUNY Delhi majoring in Veterinarian Technology.

Ryan Mogensen, son of owner Toni Mogensen, is a 2011 graduate of Holland Patent High School.  Ryan has been accepted Morrisville State College majoring in Diesel Technology. 

“The scholarship committee weighted financial need, community service, academic performance and the written explanation of several applications.  The committee used a ‘blind review’, not knowing the names of the applicants before the review process”, stated Committee Chairman Joseph Camerino.  “We are very proud of all the applicants and we want to thank everyone who applied”.  “All the applicants are winners in our minds and we are overjoyed to help in whatever way we can as an association the hard working dedicated horsemen and women here at Vernon and their families”.

JUST IN FROM THE STATE INSURANCE FUND - RELIEF IS ON THE WAY

As a result of the efforts of the Empire State Harness Horsemen’s Alliance,

consisting of the Harness Horse Association of Central New York, Vernon, New York,

the Monticello Harness Horsemen’s Association, Monticello, New York, the Saratoga

Harness Horsepersons Association, Saratoga Springs, New York, the Standardbred

Owners Association, Inc. of New York, Yonkers, New York and the Western Harness

Horsemens’ Association, Buffalo/Batavia, New York, the following result has been

secured for the benefit of all New York State horsemen, including our T-bred

counterparts. Please let your association know if this new directive is being adhered

to.

TO: ALL UNDERWRITING PERSONNEL

Re: Harness Drivers, Blacksmiths and Veterinarians

As a result of the recent WCB decision involving a harness driver, underwriting

procedures regarding certain types of individuals associated with these businesses have

been amended. Also, underwriting has decided to also change its position regarding

blacksmiths and veterinarians.

Effectively immediately, underwriters should no longer make premium charges for harness

drivers on the policies of owners or race tracks. Based on the ruling, the WCB found the

harness driver to be an independent contractor and not entitled to workers’ compensation

benefits.

In addition, effective immediately, payment made by trainers and owners to veterinarians

and blacksmiths should not be picked up as payroll. Veterinarians and blacksmiths are to

be considered independent contractors unless they work exclusively for one operation

and are considered to be a member of the operation’s staff. This applies to both harness

and thoroughbred racing.

Underwriters should be reminded to follow these instructions until further notified.

HHA OF CNY GOLF TOURNAMENT 7-19-11

We would like to thank Westmoreland Golf Club, Tom and Roxann Cullen, Abe Acee and the Nothin' Fancy staff for making the HHA of CNY Golf Tournament a huge success.  We would also like to thank Golf Unlimited.

Everyone had a great time.  Sixteen teams participated with Team Bovi taking the first place prize of new golf bags.  Team Mondi finished second winning jackets and Team Fanagula with pitching wedges.

 We are excited to announce the addition of another more affordable health insurance option available to the members of HHA of CNY. 

 We have been authorized to offer to you a new health insurance plan offered by Excellus Blue.  Enrollment will be starting on

 August 30th and you may start your coverage on 10/01/2010.

 With this new option, all eligible members are able to attain affordable health care coverage through our association. 

 

Reimbursement for single coverage is $ 250.00; 2-person coverage is $ 500.00; and family coverage is $ 750.00. 

The same eligibility requirements apply as the other plans offered.
